1. Acceptance of Terms
By accessing and using the Motoxs platform, you acknowledge that you have read, understood, and agree to comply with these Terms, our Privacy Policy, and any other applicable policies or guidelines posted on our website.
These Terms may be updated periodically, and any changes will be effective immediately upon posting. Your continued use of our marketplace after any modifications constitutes your acceptance of those revised Terms.

Motoxs acts as a venue connecting buyers and independent Vendors. We require Vendors to provide accurate descriptions, specifications, and prices for all products listed in their storefronts. However, because products are listed by third parties:
We do not guarantee the absolute accuracy, completeness, or error-free nature of product information provided by Vendors.
Vendors reserve the right to make changes to their product details, specifications, and pricing without prior notice.
If you notice any discrepancies or have questions about a specific item, please contact the respective Vendor or our customer service team before making a purchase.
4. Orders and Payment
Order Acceptance: All orders placed are subject to acceptance by both Motoxs and the respective Vendor fulfilling the order. The Vendor or Motoxs reserves the right to refuse or cancel any order for reasons including, but not limited to, product unavailability, errors in pricing, or suspected fraudulent activity.
Payment Processing: To facilitate a safe and unified shopping experience, payments are processed centrally through Motoxs. We accept various secure payment methods available at checkout.
Pricing: All prices are listed in U.S. dollars and are subject to change by the Vendors. Shipping costs, applicable sales taxes, and other charges may apply based on the Vendor’s location and your destination, and will be added to your total at checkout.
Order Confirmation: Once your order is placed, you will receive an email confirmation. This serves as an acknowledgement of your order request and does not signify acceptance until your payment is fully processed and the Vendor prepares the order for shipment.
5. Shipping and Delivery
Because items are fulfilled by independent Vendors across our marketplace, shipping policies may vary:
Processing Time: Vendors typically process and prepare orders for shipment within 1-3 business days, unless specified otherwise on the product page.
Shipping Costs: Shipping costs are calculated at checkout based on the shipping method selected, the Vendor’s origin location, and your destination. If purchasing from multiple Vendors, shipping costs may be calculated separately for each Vendor’s package.
Delivery Times: Delivery times vary depending on your location, the Vendor’s location, and the chosen shipping method.
Delivery Delays: Neither Motoxs nor our Vendors are responsible for delays in delivery caused by factors outside of reasonable control, including severe weather, carrier delays, customs procedures, or force majeure events.
6. Returns, Refunds, and Disputes
We want you to be satisfied with your marketplace purchases.
Vendor Policies: While Motoxs enforces baseline marketplace standards, specific return eligibility and processes may depend on the individual Vendor’s stated return policy. Generally, most items can be returned within 30 days of receipt if they are in unused, original condition.
Return Shipping: Customers are generally responsible for return shipping costs unless the item is defective or incorrect due to a Vendor error.
Refund Process: Refunds are processed by Motoxs once the Vendor confirms receipt and inspection of the returned item.
Disputes: If you have an unresolvable issue with a Vendor regarding a product, shipment, or return, Motoxs may, at its sole discretion, step in to mediate the dispute to ensure a fair resolution.
7. Customer Responsibility
You agree to use the marketplace for lawful purposes only. You must not:
Violate any applicable local, state, federal, or international laws or regulations.
Infringe upon the rights of others, including intellectual property rights, privacy rights, or publicity rights.
Engage in any fraudulent, deceptive, or unlawful activity.
Harass, threaten, or abuse Vendors or Motoxs staff.
Transmit any malicious software, viruses, or any other code of a destructive nature.
Failure to comply with these obligations may result in the immediate termination of your account.
8. Intellectual Property
All platform-specific content on the Motoxs website (such as our UI design, graphics, logos, and software) is the property of Motoxs and is protected by intellectual property laws. Content specific to individual storefronts (such as product images and brand logos) is the property of the respective Vendors.
You may not use, reproduce, modify, or distribute any content from our marketplace without express prior written permission from Motoxs or the relevant Vendor.
9. Privacy Policy

10. Limitation of Liability
To the fullest extent permitted by applicable law, Motoxs (including its officers, directors, and employees) acts solely as a marketplace platform and shall not be liable for:
Any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our platform.
The performance, quality, safety, or legality of the products listed by third-party Vendors.
Any actions, content, or omissions of third-party Vendors operating on the marketplace.
Our total liability for any claims arising out of or related to these Terms or your use of the website shall not exceed the amount you paid for the product or service in question.
11. Indemnification
You agree to indemnify, defend, and hold harmless Motoxs and its affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of our marketplace, your violation of these Terms, your disputes with any Vendor, or your infringement of any third-party rights.
12. Termination
We reserve the right to terminate or suspend your access to the marketplace at any time, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the website will immediately cease.
13. Governing Law
These Terms and any dispute arising out of your use of the Motoxs marketplace will be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in North Carolina for the resolution of any platform-related disputes.

Motoxs reserves the right to modify or update these Terms and Conditions at any time to reflect changes in our marketplace features or legal requirements.
